About Divorce Litigation

This is the World Wide Web site for Divorce Litigation, a monthly law journal for family law attorneys. We cover the entire field of family law, but focus primarily upon issues arising out of divorce cases.

Each issue of Divorce Litigation contains from one to three articles addressing various topics of interest within the overall field of family law. The articles cover their topic in substantial depth, and a typical article might cite 50 to 100 reported decisions. A number of recent articles have even cited case law from every state in the nation. The length of the publication is approximately 20 pages per issue.

Sample Articles

• Two sample lead articles are available. The first article, from the August, 1996 issue, is Nadine Roddy's excellent discussion of the conditions under which the court will permit a custodial parent to relocate from one state to another. This article was very timely when published, as several state supreme courts issued landmark decisions on the subject in early 1996. The published version of the article covered 22 pages, and it cites every major relocation decision rendered in the past five years. To view the full text of the article, click here.

• The second article, from the October, 1996 issue, is Laura Morgan's article on the custody and visitation rights of stepparents with regard to their stepchildren. This article is the conclusion of a two-part series on the rights of stepparents generally; the first article, in the September, 1996 issue, addressed the stepparent's duty to provide child support for stepchildren. Two-part series such as this one allow us to address topics in greater depth than we could do in one issue alone, and we publish approximately one such series per year. Laura's article is also a good representation of the breadth of our coverage, as it contains a state-by-state discussion of stepparent custody and visitation law. • Our sample shorter article, from the February, 1996 issue, is the editor's discussion of the enforceability of separation agreements which divide veteran's disability benefits. There exists a popular misconception among lawyers and judges that federal law prevents enforcement of such agreements. When one reviews the reported decisions, however, there is actually a strong basis for concluding that veteran's disability benefits can be divided by agreement.
