TORTS

• What are the parameters of the Feres doctrine, which bars service members from bringing tort suits under Federal Tort Claims Act against the Government for injuries that arose out of or in course of activity incident to service?

EMPLOYMENT OBLIGATIONS

• Federal law, including the Uniformed Services Employment and Reemployment Rights Act (USERRA), imposes several obligations toward members of the uniformed services on private employers. Employers may not deny employees job retention, advancement, or any other benefit because of their obligations to the uniformed services. Employers must grant certain leaves of absence to their employees for active military duty, and under most conditions, employers must grant reinstatement to their former employees upon request after periods of military duty.  Finally, most federal contractors must engage in affirmative action toward certain members of the uniformed services as applicants and employees.
