The Uniform Commercial Code Article 9 contains two basic concepts, “attachment” and “perfection,” which often appear to be misleadingly simple. Our attorney-clients frequently feel relief when they contact NLRG for assistance in breaking down and researching this short but important article.
Attachment occurs when the security interest is enforceable against the debtor granting the security interest. Perfection occurs when the creditor establishes his or her priority in relation to other creditors of the debtor.
