    Law of Evidence

In virtually every contested case, disputes arise over a rule of evidence or its application.  For the plaintiff, success ultimately will depend on the development of admissible persuasive evidence sufficient to satisfy the applicable burden of proof.  Conversely, a timely objection and a reasoned argument against the admissibility of crucial testimony may prove to be the decisive factor for the defendant.  For attorneys involved in litigation, the law of evidence therefore cannot be underestimated.

Trial attorneys have frequently utilized the expertise of NLRG attorneys specializing in evidentiary matters.  With access to the controlling statutory and case precedent in every U. S. jurisdiction, NLRG can provide persuasive arguments based on the evidentiary law of any state or adapted from any analogous principles of sister jurisdictions.  Questions of evidence frequently handled by NLRG include the following:

    • Objections to the admissibility of evidence based on the best evidence rule, the hearsay rule, and the dead man's statute
    • Admissibility and weight of expert and opinion testimony
    • Relevance of the parole evidence rule
    • Privileged communications as between attorney and client, doctor and patient, or husband and wife
    • Foundation requirements for documentary evidence
    • Admissibility of scientific evidence, including blood tests, polygraph results, and experiments
    • Methods of impeachment and cross-examination of adverse witnesses
    • Application of legal presumptions, and the sufficiency of the evidence to satisfy the burden of proof
    • Federal Rules of Evidence
